Ryan Ciporkin joined Lawson & Weitzen, LLP as a Senior Associate in 2011 and is currently a Partner of the Firm. Mr. Ciporkin is a highly skilled general litigation attorney with substantial experience handling all stages of litigation in federal and state courts, arbitral panels, and agencies including, but not limited to, all aspects of discovery, motion practice, and trial work. Mr. Ciporkin has litigated numerous commercial and business disputes involving employment, shareholder, partnership, restrictive covenant, public and private commercial and residential construction, real estate, product liability, insurance coverage, and breach of contract claims. Mr. Ciporkin has extensive experience handling a variety of business tort disputes involving claims of fraud and misrepresentation, deceptive trade practices, tortious interference with contractual relationships, defamation and commercial disparagement, trade secret misappropriation, breach of fiduciary relationships, misappropriation of business opportunities, and civil conspiracy. Mr. Ciporkin’s liability defense experience includes representation of nursing homes, hospitals, manufacturers, real estate brokers, insurance agents, contractors, architects, and engineers in a variety of professional, medical, product liability, and commercial disputes. Mr. Ciporkin’s employment litigation experience includes representation of management and employees relative to claims of discrimination, sexual harassment, retaliation, wrongful discharge in violation of public policy, breach of contract, violation of non-competition agreements, and non-payment of wages.

Defense Representation Matters:
• Obtained defense verdict from jury and judgment of dismissal from the court after a two week jury trial with respect to negligence, wrongful death, and Chapter 93A claims brought against nursing home operator, administrator, and parent company;
• secured lack of probable cause findings of various charges of age, disability, gender, and race discrimination claims filed by numerous claimants with the Massachusetts Commission Against Discrimination;
• obtained lack of probable cause finding as to unfair labor practices claims filed with the National Labor Relations Board;
• represented employer in defense of investigatory proceedings brought by the Fair Labor Division concerning alleged illegal deductions from employees' wages;
• obtained lack of probable cause finding as to retaliation claims filed with the Department of Labor arising out of reporting of unsafe working conditions;
• obtained dismissal of breach of contract claim involving option to purchase real estate;
• obtained dismissal of aiding and abetting liability claims brought by U.S. Securities and Exchange Commission against officer of corporation and second-chaired bench trial of remaining securities fraud claims;
• obtained summary judgment of dismissal regarding a fraud claim brought by a plaintiff in a complex business dispute over profits from the sale of products;
• obtained dismissal of claims against reach and apply defendant for lack of personal jurisdiction in dispute arising out of purchase and sale of real estate;
• represented corporate defendant in mass tort and multi-district product liability litigation including management of dozens of personal injury and wrongful death lawsuits;
• represented numerous nursing homes and assisted living facilities in defense of negligence and wrongful death claims;
• represented seller of multi-million dollar apartment building in defense of claims brought by buyer to recover alleged overpayment of purchase price at closing;
• represented insurance agent in defense of fraud, breach of fiduciary duty, and conversion claims involving alleged scheme to misappropriate funds from life insurance policy;
• represented real estate broker in defense of claims for commissions owed;
• represented company in defense of claims for tortious interference with contractual relations and misappropriation of trade secrets.

Plaintiff Representation Matters:
• prevailed in solo-chaired trial of subcontractor's claim against general contractor;
• obtained judgment for multiple damages for property owner against contractor in residential construction dispute;
• secured judgment for multiple damages and attorneys' fees on behalf of retailer against vendor for supply of defective goods;
• recovered arbitration award invalidating a common expense assessment, awarding restitution of payments made towards assessment, and awarding attorney fees for bad faith in dispute involving the restoration of a condominium following a major casualty loss;
• secured highly favorable settlement on behalf of whistleblowers who were wrongfully terminated after they reported falsely inflated profits made by company;
• obtained highly favorable result at mediation of gender discrimination, sexual harassment, and hostile work environment claims;
• represented shareholder of close corporation in pursuit of breach of fiduciary and freeze-out claims;
• arbitrated grievance of wrongful termination and obtained reinstatement for police officer;
• represented partner in action for dissolution and winding up of partnership;
• represented company in assertion of fraud, conversion, and breach of fiduciary duty claims against former officer of company who allegedly falsely inflated profits and caused massive losses to shareholders;
• represented various companies in assertion of claims against former employees for violation of non-competition, non-solicitation, and confidentiality covenants;
• represented architectural designer in assertion of multi-million dollar affirmative fee claims against owner of a public construction project for services rendered;
• obtained highly favorable settlement for general contractor in lawsuit involving owner’s violations of Prompt Payment Act and failure to pay compensation owed for work and extra work performed;
• obtained favorable settlement on behalf of real estate investors against real estate broker and developer in dispute involving fraud, civil conspiracy, and aiding and abetting claims;
• represented individual in assertion of malpractice claims against accountant arising out of failure to timely file returns and loss of ability to claim tax loss carrybacks;
• obtained favorable settlement in breach of trust dispute involving claims brought by trust beneficiary against trustee who failed to comply with liquidation and distribution provisions of trust instrument; and,
• represent wholesaler in action against distributor for unfair trade practices involving fraudulent container redemption scheme.
